I think there are two situations in this case.

When both of them who had extramarital affairs want to resister the birth, and neither of them want to that.

Recently It happen when couples dirvorce nobody want to have custody of their chlldren, so continue the sue.

It is natural that he(or she) should have the right who can give good condition for children in the custody and resistration.
