I understood why it's 4.
But I don't know why number 2 is right.
Isn't the infinitive coming after would?

You're correct, this is a correct sentence. 
First of, you're also right when you mentioned that an infinitive usually comes after modal verbs like would. 
The case on the sentence you have provided though was that 'never to return' is actually an idiom added to the sentence. It served as a phrase fragment.
